Terms of Service

Please read these Terms of Service ("Terms") carefully before purchasing or using AuthorRally. By checking the agreement box during checkout, you confirm that you have read, understood, and agree to be bound by these Terms in full.
1. The Service
AuthorRally ("the Service," "we," "us") provides self-published authors ("you," "the Author") with tools to build pre-release interest and post-release reviews for a book, including but not limited to: a countdown page, a supporter sign-up wall, an automated email campaign, referral tools, and optional add-ons described elsewhere on the site. AuthorRally is a software tool. We do not write, edit, publish, distribute, or market your book on your behalf, and we make no representation about the sales, reviews, or outcome your book will achieve.
2. Fees and Payment
Access to AuthorRally for a given book is provided in exchange for a one-time, per-book fee (currently $69 for one book or $99 for two books), charged once at the time of purchase. This is not a subscription and will not recur.
3. No Refunds
All purchases are final. Because AuthorRally grants immediate access to digital tools and services upon payment, we do not offer refunds, credits, or exchanges for any reason, including but not limited to a change of mind, a delayed or cancelled book release, dissatisfaction with results, or a decision not to use some or all of the features included with your purchase. It is your responsibility to review the Service's features before purchasing.
4. Your Responsibility to Use the Service
AuthorRally provides the tools; you are responsible for using them. We are not responsible or liable for any outcome, or lack of outcome, that results from your decision not to upload contacts, not to send scheduled communications, not to set a buy link, not to complete your author profile, or otherwise not to actively use features included with your purchase. If you do not use a feature you purchased, that is not a defect in the Service and is not grounds for a refund or claim against us.
5. Text Message (SMS) Notifications
Where enabled, text message notifications are limited strictly to a single, one-time message sent on the book's release day, and may not be used by you or on your behalf for any other campaign communication. Message and data rates may apply to the recipient. By providing a supporter's phone number to the Service, you represent that the supporter has consented to receive this one-time message from you. You, the Author, are solely responsible for compliance with all applicable telemarketing and messaging laws (including, in the United States, the Telephone Consumer Protection Act) in connection with any phone numbers you collect or upload.
6. Email Communications
Every email sent through the Service includes a working unsubscribe link, and we do not knowingly send repeat, unsolicited communications to any contact who has opted out. You represent that any contact list you upload consists of people you have a legitimate relationship with or reasonable basis to contact, and that you will not use the Service to send unsolicited bulk communications to purchased, rented, or scraped contact lists.
7. Reviews and Marketplace Policies
The Service is designed to help you request honest reviews in a manner intended to be compliant with Amazon's and other marketplaces' policies against incentivized reviews. We do not guarantee that your use of the Service complies with any specific marketplace's terms of service, which may change at any time. You are solely responsible for your own compliance with Amazon's (or any other platform's) policies, and we are not liable for any review removal, listing suspension, or account action taken against you by a third-party marketplace.
8. Your Content
You retain all ownership rights to your book, your bio, your photos, your cover art, and any other content you upload ("Your Content"). You grant AuthorRally a limited license to display, transmit, and store Your Content solely as necessary to provide the Service to you and your supporters. You represent that you own or have the right to use everything you upload, and that doing so does not infringe any third party's rights.
9. Limitation of Liability
To the fullest extent permitted by law, AuthorRally and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, sales, or data, arising from or related to your use of, or inability to use, the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you actually paid us for the book in question.
10. Indemnification
You agree to indemnify and hold harmless AuthorRally and its owner from any claim, demand, loss, or damage (including reasonable legal fees) arising out of your use of the Service, your content, your contact lists, or your violation of these Terms or of any law or third party's rights.
11. Changes to the Service or These Terms
We may update these Terms or change, suspend, or discontinue any part of the Service at any time. Continued use of the Service after a change to these Terms constitutes acceptance of the updated Terms.
